In case of an infringement of the General Data Protection Regulation (AVG) the Data Protection Authority (AP) can impose a fine on the perpetrator. This can be an administrative fine or an order for periodic penalty payments. Both are imposed by decree. One can lodge an objection and an appeal against such a decree. In an appeal procedure the Court will review whether the Data Protection Authority has acted in accordance with the law and the general principles of sound administration.
