Sick leave and reintegration

In case of sickness the employee continues to be entitled to wages. The doctor of the occupational health and safety service (ARBO) determines whether an employee is ill or whether, in actual reality, there is a labour conflict. Many disputes can arise in relation to sickness and reintegration, such as:

  • Is the employee still entitled to wages (continued payment)?
  • Can payment of wages be stopped during sickness?
  • Is an extension of the period of 104 weeks in which wages must continue to be paid (‘wages sanction’) appropriate?
  • Which reintegration duties do the employee and the employer have?
